Lasting Power
Of Attorney

Under the Mental Capacity Act (2005) an individual has the right to put in place an attorney to deal with their Property & Finances and decisions about their Health & Welfare, in the event of them being assessed as lacking Mental Capacity to make the decisions for themselves.

WHY DOES IT MATTER?

In England and Wales, if a person has a mental disorder (such as Dementia, Learning Disability, etc) and is assessed as lacking mental capacity to make a specific decision, then a framework known as the Mental Capacity Act (2005) takes effect. This means that decisions are no longer made by the individual.

​

Under law, families do not have any automatic jurisdiction to make decisions on behalf of their loved ones. This means that professionals, who in most cases have no previous acquaintance, are in charge of decisions made about your loved ones.

​

By putting in place the Lasting Power of Attorney, you can safeguard your future and ensure that people who know you are making the decisions you would want in the event that you can no longer make the decisions for yourself.

We can complete what is known as a LPA Certificate.

​

This involves one of our team of experienced Mental Capacity Assessors visiting you or your loved one in person at a convenient time, or even completing a remote assessment via secure video link.

​

These assessments take approximately 1 hour to complete, but will leave you safe in the knowledge that everything is being done to maintain you or your loved ones autonomy.

​

Our assessors will ensure that you or your loved one are not being pressured into making a LPA, and that you are able to understand, retain and weigh-up why an LPA is the right decision for you.
